Trial Could Mean Justice For Earl Washington, Jr.

RICHMOND, VIRGINIA--Kenneth Maurice Tinsley is finally to stand trial next week for the 1982 rape and murder of Rebecca Lynn Williams.

Tinsley, who is already serving a life sentence for a separate rape conviction, could face the death penalty if convicted of this crime.

While a conviction would mean justice for Williams' family, it might also be considered justice for the man who spent 18 years in prison -- nine of it on death row -- for the crime.

Earl Washington, Jr. came within a few days of execution for the crime to which he had confessed, but which DNA tests later cleared him and implicated Tinsley.

In May of this year, a jury ordered the estate of State Police investigator Curtis Reese Wilmore to pay $2.25 million to Washington, upon finding that Wilmore fabricated evidence leading Washington to confess.

During that trial, experts testified that Washington, who has been described as having mild mental retardation caused by an early childhood brain injury, was easily pressured into confessing to the crime.

According to the Associated Press, Washington's lawyers are now seeking $1.6 million in fees and expenses. A federal judge will decide whether the state should pay those fees.
